A Cheyenne man who ran from police with methamphetamine in his pocket was sentenced Thursday in Laramie County District Court to two to four years in prison.

Xavier E. Garcia was arrested on Oct. 6 after police smelled marijuana coming from his truck, tried to cuff him and he took off running.

Police tackled Garcia to the ground a short time later and found 5.1 grams of methamphetamine in his pocket. A total of 0.6 ounces of marijuana was also found in several different containers in Garcia's truck.

As part of a plea agreement, Garcia pleaded guilty to felony possession of methamphetamine later that month.

In exchange for his plea, the state agreed to drop the two other counts in the case as well as two misdemeanor dockets and argue for three to six years imposed.

Garcia's attorney, Emily Harris, asked Judge Catherine Rogers to consider probation, but Assistant District Attorney David Singleton said Garcia had been given "numerous chances."

"I agree with the state," said Rogers. "I think that you have had numerous opportunities ... and yet we have another situation where you're coming before the court with a felony amount of meth."

In addition to the two to four year sentence, Rogers also ordered Garcia to complete the Intensive Treatment Unit program.
