Cheyenne Police Chief Brian Kozak says transgender people could face indecent exposure charges in Cheyenne if they use a public shower or locker room that doesn't correspond to their biological sex.

The chief says indecent exposure laws clearly prohibit people from displaying their "private parts in public." He says his department would interpret a biological male who tried to use a female shower--or vice versa-as a violation of that law.

He says that would be true regardless of whether the person self-identifies as the opposite sex of their biological gender. The chief says that would include showers in Cheyenne public schools.

He says police act on the basis of "probable cause," and such a case would be probable cause to take action. He says it would then be up to the Laramie County District Attorney and the courts to decide the issue.
