A bill that would clarify what amount of pot-infused edible or drinkable products would be needed to charge someone with a felony has died in the Wyoming House after being approved in the state Senate.

The bill failed to make a deadline for introduction in the Wyoming House. Senate File 23 would have set the felony amount of drinkable pot products at 36 fluid ounces. For concentrated marijuana resin products, the felony amount would have been set at three grams, the same amount needed to charge someone with felony possession of meth and other drugs under Wyoming law.

For other edible pot products, the felony amount would have been set at three ounces. Wyoming prosecutors have been frustrated by the lack of a definition of felony amounts of edible and drinkable pot products under state law, which has caused judges to throw felony charges in such cases out of court.

Wyoming lawmakers have struggled with the issue for years.
