Drummer Alex Van Halen married Kelly Carter in 1984 and she stayed his wife until 1996, when they divorced. She kept the last name and all was well with the world until she dared to start her own business, Kelly Van Halen.

A lawsuit filed in California federal court claims the band, Van Halen, are suing their drummer's ex-wife, and is accusing her of illegally exploiting the band by using her own last name and they claim that Kelly Van Halen products and services constitute trademark infringement, dilution and unfair competition with the band's own merchandise.

And there you have it. It’s all about the Benjamins. And they not only want Kelly barred from selling products under the name, but they also want them all destroyed and they want to snark any and all profits from anything already sold.

I can imagine how you feel about an ex, but as an impartial observer, how would you rule?
