A 50-year-old Cheyenne woman is facing a felony charge after allegedly committing burglary.

Arrested on Warrant

According to a booking sheet, police arrested Tanya Marie Hernandez at her home in the 1600 block of West Jefferson Road at 8:30 p.m. on Tuesday, Aug. 26.

Police say Hernandez had a warrant for burglary, a felony punishable by up to 10 years in prison, up to a $10,000 fine, or both.

The crime is alleged to have occurred on or about Saturday, Aug. 16.

Initial Court Appearance

On Wednesday, Aug. 27, Hernandez was seen in Laramie County Circuit Court in front of Judge Antoinette Williams on the charge.

"I would ask for an OR (own recognizance) bond due to the fact that I'm from Cheyenne and I own a business here," said Hernandez.

But the state said it had concerns for the safety of the community and Hernandez's ability and willingness to comply with court orders, given the "deliberate nature" of the charge and her criminal history.

"(She) has a history of fraudulent behavior from 2014 ... theft from 2018 ... failing to appear in 2018 and 2022, as well as being a fugitive from justice in 2019, and a contempt of court from 2020," the state said. "For those reasons the state believes that a cash bond is appropriate and would request $4,000 cash."

Out on Bond

Williams set Hernandez's bond at $2,000 cash, which she later posted, and set her bond conditions, ordering she do drug and alcohol testing through Foundations and have no contact with any Walmart anywhere.

"Why am I being tested for drugs and alcohol when I wasn't charged with anything to do with that," questioned Hernandez.

"Because you have a prior history of convictions related to drugs," said Williams.

Hernandez's next court date will be a preliminary hearing on Wednesday, Sept. 9, at 3:45 p.m.
