Cheyenne Transient Accused of Threatening Hotel Employee With Bat
A 27-year-old Cheyenne transient is facing a felony charge after allegedly threatening a hotel employee with a baseball bat.
According to a booking sheet, police were called to TownePlace Suites at 1710 W. Lincolnway at 11:17 a.m. on Aug. 16, 2024, for a threat with a stick.
Suspect Claims Self-Defense
Police say they contacted Fabian Manuel Hernandez, who had a baseball bat, in the area of 1700 W. Lincolnway, and when they asked him about the incident, he said he was acting in self-defense.
Police then went to the hotel to speak with the victim and the witness/original caller, both employees of the business.
The victim reportedly told police that he had asked Hernandez to leave and Hernandez became irate, presented an object, and threatened him, causing him to feel threatened for his safety.
The witness/original caller reportedly corroborated the victim's story and told police that he felt Hernandez was going to hit the victim.
Police say after talking with the hotel employees, the object appeared to resemble a baseball bat, which is what Hernandez had in his possession when police contacted him.
Police say the hotel employees denied threatening Hernandez, and there was no evidence to back up Hernandez's self-defense claim.
Hernandez Arrested, Charged With Aggravated Assault
Hernandez was located on the Greater Cheyenne Greenway just east of the 1000 block of Deming Drive and arrested.
He was subsequently charged with aggravated assault and battery - threatens to use a drawn deadly weapon, a felony punishable by up to 10 years in prison.
Hernandez made his initial appearance in Laramie County Circuit Court on Aug. 19, 2024, during which his bond was set at $3,000 cash and his preliminary hearing was scheduled for Aug. 28, 2024, at 2 p.m.
