A 39-year-old Hay Springs, Nebraska man is facing a felony charge after allegedly strangling his girlfriend following a Cheyenne Frontier Days concert.

According to a booking sheet, Derek Ginn and his girlfriend of 4.5 years were reportedly arguing in the car on the way home from Thursday night's Tim McGraw concert and she wanted to get out of the car.

When Ginn stopped the car and his girlfriend attempted to get out, he reportedly put her in a chokehold from behind and prevented her from leaving the car.

Cheyenne police say Ginn's girlfriend told them she struggled to breathe while Ginn had his arms around her neck and repeatedly told him to let her go, but he continued to drive, locked the doors, and sped up every time she tried to get out.

Ginn's girlfriend later ran to the neighbors to ask for help, but Ginn reportedly dragged her by her left forearm back to their location, preventing her from getting help.

She then got into the driver's seat and left the location with Ginn reportedly grabbing onto the car, trying to get her to stop.

Ginn was subsequently arrested and booked into the Laramie County Detention Center on charges of strangulation of a household member - minor injury and domestic battery.

He made his initial appearance in Laramie County Circuit Court Monday morning, after which he posted $5,000 cash bail.

Ginn's next court appearance will be a preliminary hearing on Aug. 25 at 3:30 p.m.

UPDATE:

The Laramie County District Attorney's Office on Sept. 27 dismissed the strangulation charge against Ginn and he pled guilty to unlawful touch.
