Weaver Fails to Appear for Court, Judge Issues Warrant

Laramie County Circuit Court Judge Thomas Lee on Friday issued a failure to appear warrant for Andrew Weaver, the 25-year-old charged in last week's shooting in east Cheyenne that killed two people and seriously injured two 14-year-old boys.

Weaver was supposed to appear in two separate dockets, one charging him with misdemeanor theft and misdemeanor possession of methamphetamine, and the other charging him with two counts of second-degree murder, attempted second-degree murder and two counts of aggravated assault.

But Laramie County District Attorney Leigh Anne Grant Manlove explained to Lee that a federal grand jury on Tuesday returned an indictment against Weaver for being a felon in possession of a firearm in connection with the Sept. 16 shooting, and that he was in the custody of the U.S. Marshals Service.

"Should I issue a failure to appear warrant," Lee asked Manlove.

"I wouldn't go that far," she said.  "According to the writ, he'll be returned after the federal case is adjudicated."

Even Weaver's attorneys asked that Lee not issue a warrant, saying they hadn't even met with him yet.

Lee said he was surprised the federal charge would "trump the state's interest."

"I appreciate that it might not be his (Weaver's) fault," he said.  "But I don't think the feds taking him excuses his failure to appear for this court proceeding."

Weaver's arraignment and detention hearing on the federal charge is scheduled for Monday at 1:45 p.m.
